John’s practice is centred on patents and registered designs and spans a broad range of technologies. Known for his broad IP knowledge, analytical mind and creative problem solving skills, John’s counsel on complex or unusual IP matters is sought regularly by both his professional peers and clients.
In addition to the preparation, filing and prosecution of patent and registered design applications, John also enjoys providing strategic and complex advice, including in regard to patent and registered design filing strategy, prosecution strategy and enforcement/litigation strategy. John was one of the first Australian attorneys to make use of the common design provision introduced by the Designs Act 2003, which allowed registration of a common design in relation to multiple products to be sought in a single application. John also has special interest in “new classes” of designs, such as digital graphics, graphical user interfaces (GUI) and animations, and in the overlap between registered designs, shape trade marks and copyright. John is active and respected in the international designs community, being a member of the IPTA designs committee and of the IPONZ designs technical focus group.
John has significant experience in assisting clients resolve intellectual property disputes. Whilst John has substantial experience in providing litigation support to clients in proceedings before the Federal Court of Australia, at both first instance and appeal level, he always encourages his clients to consider settling disputes on reasonable commercial terms. John’s experience in this area includes infringement/Freedom-to-Operate opinions, invalidity opinions, letters of demand/cease and desist letters, settlement negotiations, oppositions, re-examinations and litigation support.
Outside work, John is a busy father of five children. When his schedule allows, John enjoys performing with several Sydney musical theatre companies to raise funds for various charities. John is also the founding member of the FB Rice Oxfam Trailwalker team and has completed the Oxfam Trailwalker Sydney’s challenging 100km trail four times to raise significant funds in support of Oxfam Australia’s goal of making poverty history. John is also proud to have served as a commissioned officer in the Australian Army Reserve from 1999 to 2010.
